山水林田湖草系统保护综合行政执法:问题和对策

Study on Problems and Countermeasures of Comprehensive Administrative Law Enforcement for Systematic Protection of Mountains, Rivers, Forests,Farmlands, Lakes and Grasslands

山水林田湖草是生命共同体,对其进行系统保护和综合执法是其自然整体性的要求,也是提高执法成效、强化法律保护、实现生态文明发展战略的必然要求。但当前山水林田湖草综合行政执法中尚存在缺乏系统性、整体性理念,相关法律法规不健全,执法不力、行刑衔接不畅和体制机制不甚健全等问题。必须坚持问题意识和目标导向相结合,进一步更新执法理念,完善法律体系,整合执法力量,规范执法流程,健全监督机制,优化保障体系,充分发挥综合执法的效能,达到系统全面保护的目的。

Systematic protection and comprehensive law enforcement for the idea of taking mountains, rivers, forests, farmlands, lakes and grasslands as a life community are the requirements of its natural integrity. It is also an inevitable requirement to improve the effectiveness of law enforcement, strengthen legal protection and realize the development strategy of ecological civilization. However, there are still many problems in the comprehensive administrative law enforcement of mountains, rivers, forests, farmlands, lakes and grasslands, such as a lack of systematicness and holistic concept, imperfect related laws and regulations, ineffective law enforcement, poor connection of administrative law enforcement and criminal justice, and inadequate institutional mechanisms. We must adhere to the combination of problem awareness and goal orientation, further update the law enforcement concept, improve the legal system, integrate law enforcement forces, standardize the law enforcement process, improve the supervision mechanism, optimize the security system, and give full play to the effectiveness of comprehensive law enforcement to achieve the goal of comprehensive system protection.
