治理主体性理论从逻辑、历史、实践等角度对法治构成支持。治理主体性来源于人之为主体并以主体身份进入社会及政治场域的基本属性,这一定性实现了对人的诸多传统状态的历史突破,并为构筑新型政治实践奠定基础。新的治理主体性设置创造了法治意义上的人,构筑了法治的基本价值立场,明确了政治权力在法律中的定位。治理主体性从培育权利及控制权力两个方面推动法治的成长及进步,并为自治性法治体系的形成确立逻辑起点和运作机理,进而推动创造了治理公共性及开放性的法律架构。

Governance subjectivity theory support the rule of law from logic, history, practice and other as- pects. Governance subjectivity originate from the basic attribute that human being exist in social and political field as subjectivity, this qualitative establishment take a historical breakthrough to many traditional historical status of human, and make the foundation for new political practice. The new setting on political subjectivity created the human in the sense of rule of law, built the basic value standpoint of rule of law, and made the position of political power clear in the law. Governance subjectivity promote the growth and progress of rule of law in both aspect of cultivating right and controlling power, establish the logic start and operation mechanism for autonomy legal system, thus push forward to create the publicity of governance, and bring about open legal framework.
