出入境管理中等待遣送出境外国人的危险性证明机制研究

对于等待遣送出境的外国人适用羁押措施是为了防范其具有逃避执行或者实施违法行为的危险。因此，证明等待遣送出境的外国人具有较高的危险性应当是对其使用羁押措施的前提条件。为此，可以从证明对象、证明责任、证明标准、证明方法四个方面结合出入境管理工作实际，构建和完善等待遣送出境外国人的危险性证明机制。

The application of custody measures to foreigners awaiting removal from the country is to prevent them from having the danger of evading execution or committing illegal activities. Therefore, proving that foreigners awaiting deportation have higher risks should be a prerequisite for their use of custody measures. To this end, it is possible to combine the actual status of entry and exit management work from the four aspects of object of proof, burden of proof, standards of proof, and method of proof, and establish and improve a mechanism for proof of the danger of awaiting the repatriation of foreigners.
