略论西部民族地区流域环境保护的法制理论

The Legal theory of Watershed Environmental Protection in the Western Ethnic Areas in China

西部民族地区拥有我国丰富的自然资源,长江、黄河水系均发源于此。因此对于西部民族地区流域环境的保护不仅关系到西部民族地区自身,亦对下游我国经济发达地区的发展具有重要的意义。对于西部民族地区流域环境的保护,长期以来处于碎片化、分散化的状态,缺乏系统的措施和法制手段对其进行治理和保护。文章从西部民族地区流域环境法制保护出发,分析西部民族地区流域环境的流域模式和历史观,在其基础上构建西部民族地区流域环境保护法制理论框架。

The western ethnic areas possess the main basin resources in our country, and the water system of the Yangtze River and the Yellow River originated here. Therefore, the protection of the watershed environment in western ethnic areas is not only related to the western ethnic areas themselves, but also of great significance to the development of the downstream economically developed regions in China. For the protection of the watershed environment in western ethnic areas,it has been fragmented and dispersed for a long time, and it lacks systematic and legal means to govern and protect it.Based on the protection of the watershed environmental protection system in the western ethnic minority areas, this paper analyzes the basin model and historical view of the basin environment in western ethnic areas, and builds the theoretical framework of the watershed environmental protection legal system in the western ethnic areas.
