论我国宪法解释制度的体系化构造

On the Systematic Construction of China's Constitutional Interpretation System

由于缺乏对宪法解释制度的构造体系化分析,我国的宪法解释持续面临规范、理论与实践的三重角力。推进宪法解释与宪法实施、司法实践需求以及建设法治中国深具逻辑关联性。对实践类型的探索夯实了宪法解释的研究基点,呈现了改革在宪法解释发展中的动因性与指向性。宪法解释的问题可以解构为提议主体和事由、议事程序、文件名称、效力地位等五个方面。在秉持微调释宪权力运行构架的原则下,推动五个方面的体系化构造,可以助力宪法解释的新发展。

Due to the lack of structural analysis of the constitutional interpretation system,China＇s constitutional interpretation continues to face the struggle between norms,theory and practice. Promoting the interpretation of the Constitution and the implementation of the Constitution,the need for judicial practice,and the construction of the rule of law China are highly logically related. The exploration of the type of practice reinforces the research basis of constitutional interpretation and presents the motivation and orientation of reform in the development of constitutional interpretation. The problem of constitutional interpretation can be deconstructed into five aspects： proposing subject and cause,procedure,document name,and validity status. Under the principle of fine-tuning the constitutional power of operation,it can promotes the systematic structure of the five aspects and provide new developments of constitutional interpretation.
