河北省清洁生产立法问题研究

Research on Legislation of Cleaner Production of Hebei Province

清洁生产强调整个产品生命期的污染控制和能耗最小化,是解决河北省生态环境问题的必然选择和最佳模式。因此,应制定《河北省清洁生产促进条例》,为推动全省清洁生产提供法律依据和立法保障。河北省清洁生产立法应以解决清洁生产中的突出问题为宗旨,理顺清洁生产地方立法与相关立法的关系,坚持三大产业全覆盖、京津冀协同发展等立法原则,针对清洁生产行政管理、清洁生产审核等关键环节作出制度安排,并完善清洁生产教育、培训、融资等方面的配套制度建设。

Cleaner Production is the inevitable choice and optimal pattern to solve the problem of ecological environment in Hebei Province,which emphasizes pollution control and minimum energy consumption of the whole product cycle. Therefore,it is necessary to enact Cleaner Production Promotion Statute of Hebei Province,which will provide legislative basis and legislative guarantee for promoting cleaner production of Hebei Province. Legislation of cleaner production of Hebei Province should solve existing problems in the provincial cleaner production,hackle the relationship between local legislation of cleaner production and relevant legislation. Legislative principles,such as covering the three main industries,Beijing-Tianjin-Hebei Collaborative Development,should be followed. Institutional arrangements for key links like administrative management of cleaner production and audit of cleaner production should be made. The supporting systems about cleaner production education,training and financing should be improved.
