共享经济的发展及其监管模式的探索

The Research of the Development and Regulatory Framework of the Sharing Economy

摘要 在经济新常态下,党和国家高度重视发展共享经 济,提出要实施“互联网+ ”,发展共享经济.但对于如何监 管共享经济这种新的经济形态,则存在不同观点.有一种观点 认为,应该要少一点干涉这些飞速发展的由科技推动的新行 业;而另一种观点则主张,要建立一种新的管理构架和制度来 解决这些问题;还有第三种观点认为,过多的干涉、约束可能 会导致对创新的扼杀,而竞争规则才是解决相关数字市场中 市场支配力问题的正确法则,但现有的竞争机制亟须修改并 加大执法力度才能应对共享经济中面临的种种挑战.本文首 先介绍了共享经济的概念和发展,然后从几个问题的角度讨 论以上三种观点和争议,最后进行总结,并建议在共享经济领 域建立以竞争法调整为主,其他监管、自律为辅的混合式监管 模式,希望能促进对相关立法改革进行更深入的研究. Under the developing of new normal economy, the govern-ment attaches great importance to the implementation of Internet, called internet+ , and hope to develop the sharing economy. But some believe they should refrain from intervening in fast-moving, technology driven industries, as the cost of intervention in those industries would generally outweigh possible benefits. Others have argued that a muscular intervention from government is needed, and a new regulatory framework would be required to address prob-lems. A third group argues that competition policy is the right tool to address issues related to market power in digital markets. In this article, after having defined the sharing economy and its development, I will discuss in turn the above arguments and criticisms. Then I will conclude and suggest that the regu-lation of sharing economy should works in a mixed model : the competition law should as the main and other regulatory framework should as the supple-ment Whilst some of the proposals to further enhance the effectiveness of the enforcement system may have some merit in principle, more in-depth research would be required before any legislative reform.
