论“双向运动”与现代社会法的兴起

On “Double Movement” and the Rise of Modern Social Law

社会法并非自古就有的部门法,学界一般认为,20世纪以来,特别是第二次世界大战之后,随着"看不见的市场之手"的失灵和社会风险、经济不确定性的日益加剧,社会法由此兴起。本文从波兰尼的"双向运动"理论出发,并结合形式法范式到实质法范式的法律发展轨迹,分析、探讨了"双向运动"对现代社会法的深刻影响。最后得出结论,波兰尼的"双向运动"理论对社会法的兴起起到了不可磨灭的作用,具体表现在:为弥补形式法范式法律的不足以及面对日益增加的社会风险,带有追求实质正义气质的现代社会法从"双向运动"中被发现并逐渐兴起;在反市场扩张的社会保护运动中所彰显的劳动力"去商品化"理念是现代社会法的逻辑起点和理论核心;对社会自我保护本能的承认和实现,就是最初的社会法制度形式,或者说,是社会法制度的先驱。

Social law is not a department law in ancient times,The academic circles believe that since the beginning of 20 th century,especially after World War II,with the malfunction of ＂invisible market hand＂ and with the seriously deepening of social risk and economic uncertainty,social law rises based on this. Based on Polanyi＇s ＂Double Movement＂ theory,by combining law development logic from form law to practice law,this paper analyzes and discusses the deep influence of ＂Double Movement＂ on modern society,and finally draws the conclusion that Polanyi＇s ＂Double Movement＂ theory plays irreplaceable role in the rise of social law. It is really embodied that the modern social law with the pursuit of practical justice is discovered and rise from＂Double Movement＂in order to offset the deficiency of form style law and with the increasing of social risk. The logic starting point and theoretical core of modern social law are decommercialization idea of labor revealed in social protection movement for countering market expansion,the recognition and implementation for social self-protection instinct is initial form of social law system,in other words,is the pioneer of social law system.
