摘要
分享经济下劳动关系的认定问题是当前社会亟须解决的法律问题。如何平衡新型用工形式的灵活创新和弱势劳动者的倾斜保护,成为完善劳动关系认定标准的一大挑战。本文以互联网O2O模式中的外卖配送为例,通过分析分享经济下劳动关系的理论基础以及我国当前对分享经济劳动关系认定的现状考察,得出该种模式下我国劳动关系认定存在的问题,即包括缺乏有效的立法规制、相关认定标准过于僵硬等,最后结合实践提出完善我国分享经济下劳动关系认定的建议及意见,以期既能保护经济创新,又能实现对相关劳动者的倾斜保护。
The accreditation of labor relations under the sharing economy is a legal issue that needs to be solved immediately in current society. How to balance the flexibility and innovation of the new employment torms and the inclined protection to disadvantage workers is a great challenge to improve the accreditation criteria of labor relations. This paper, taking the take-out delivel7 in the 020 model through Internet as an example, analyzes the theoretical basis of labor relations under the sharing economy and Chinese current status to the accreditation of the labor relations of sharing economy, and finds the existing problems in the accreditation of Chinese labor relations through this model. The existing problems are mainly lacking of eitective legislative regulation and excessively rigid accreditation criteria. Thereiore, this paper puts tbrward some opinions and suggestions on improving the accreditation of labor relations under Chinese sharing economy, in order to protect economic innovation and achieve inclined protection tot related workers.
