摘要
我国《环境保护法》修订创制环境民事公益诉讼机制以来,一方面,学界对我国环境诉讼体系的实践发展持充分肯定,另一方面又为该体系支离的现状提出了许多意见和补充。结合风险社会的特点,国家环境行政权的强化与环境责任负担的增加,应为当代政府组织的基本原则,亦必须通过确立以环境行政诉讼为主体的司法机制予以加强。个人提起的环境行政诉讼,也应成为环境法诉讼体系的突出特点和重要部分。
Since China's Environmental Protection Law has been revised to create a civil public interest litigation mechanism,the academic community,on the one hand,fully affirm the practice and development of China's environmental litigation system,on the other hand,give many opinions and supplements to the current situation of the system. Combining with the characteristics of the risk society,the strengthening of the state environmental administrative power and the increase of the environmental responsibility burden should be the basic principles of the contemporary government organizations,which should be strengthened through the establishment of the judicial mechanism that takes environmental administrative litigation as the object. Environmental administrative litigation put forward by individuals should be a prominent feature and important part of environmental law litigation system.
