My Opinion on the Regulation of Bidding Chaos in Construction Market

建筑市场招投标制度是当前国际上较为通行和科学合理的工程承发包交易形式[1]。建设项目通过招投标方式选择施工队伍和确定工程价款,在一定程度上保证了工程质量、安全和工期等硬性指标,更规避了人为腐败的风险,让整个项目在公正、公平和公开的环境中运行,一度被赞誉为"阳光法案"。但由于我国现行管理机制不完善,法制不健全,致使部分招投标工作在具体实施过程中乱象丛生,给建设项目埋下了严重的质量和安全隐患。

The construction market bidding system is a relatively popular and scientific and reasonable project contract mode in the international market. In the construction project, the construction team is selected and the project price is determined by means of bidding, which can guarantee the rigid indexes of the project, such as the quality, safety, time limit and so on. It also avoids the risk of human corruption and enables the whole project to run in a fair and open environment. It was once praised as the ＂sunshine bill＂. However, due to the imperfect management mechanism and imperfect legal system in our country, part of the bidding work has become chaotic in the course of concrete implementation,which buries serious quality and safety problems in the construction project.
