浅析我国单身女性的生育权

Analysis on the Reproductive Rights of Single Women in China

随着社会发展和人们生育观念的转变,越来越多的单身女性希望能够生育子女,但是,我国的《宪法》、《计划生育法》等并没有赋予单身女性的生育权。单身女性没有缔结婚姻、将来也没有缔结婚姻的意愿,无论是从生育权的人权属性的角度来看,还是从社会养老保障的角度来看,都应当赋予单身女性生育权。单身女性的生育权是对传统的夫妻生育权的突破。为了避免单身女性生育权遭到滥用,应当对单身女性的婚姻缔结、生育年龄、身体状况和生育法式等方面进行限制,从而避免单身女性生育权遭到滥用。

Along with the social development and the transition of the concept of child-bearing,more and more single women want to be able to have children,however,the constitution of our country,such as the family planning law did not give single women＇s reproductive rights. Single women with no conclusion of marriage now and future,whether from the point of view of human rights attribute of the reproductive rights,or from the perspective of social old-age security,should be given a single female reproductive rights. The reproductive right of single women is a breakthrough of traditional couples＇ reproductive right. In order to avoid a single female reproductive rights abuses,some limits should be set for single women ＇ s marriage and childbearing age,physical condition,and birth methods,etc.
