摘要 采用文献资料法等,对2015年《世界反兴奋剂条例》的制定背景、修订内容、修订主旨等相关问题进行研究。得出结论:新条例从实体权利和程序权利2方面强化对运动员合法权益的保护;在对兴奋剂违规运动员进行惩罚时,广泛采用比例原则;新条例的主旨在于弘扬人权精神,切实保护运动员及其辅助人员的合法权益,确立慎罚观念,减少处罚权行使的恣意性。提出建议:在反兴奋剂实践中,我国反兴奋剂机构应研究2015年《世界反兴奋剂条例》,充分领悟其立法宗旨,为规则的更新储备经验和打牢基础。 By using the method of literature review, this paper makes analysis on development background, revision content and revision purport of World Anti-Doping Rules 2015. The result shows that two new regulations from the substantive rights and procedural rights to strengthen the protection of the legitimate rights and interests of the athletes, in the athletes for doping; discipline punishment and widely used the principle of proportionality; the thrust of the new regulations is to carry forward the spirit of human rights protection, effectively protect the legitimate rights and interests of the athletes and teaching staff, establish the careful punishment idea, to reduce the punishment right. Suggestions: In the Anti-doping practice, China’s Anti-Doping Institutions should study the World Anti-Doping regulations of 2015 and fully understand its legislative purpose, In order to renew the experience and lay the foundation for the renewal of the rules.
