人证在刑事指控体系中的运用——以庭审实质化改革为背景

The application of human testimony in criminal accusation system——Based on the reform of the substantive trial

完整的刑事指控体系含起诉指控体系和庭审指控体系两部分。历史上人证曾经是刑事指控体系的核心内容,现阶段仍然是构建刑事指控体系的关键环节。当前,庭审实质化的改革正显性地调整着人证在起诉指控和庭审指控中的作用。在此背景下,为主动适应庭审实质化改革的需要,既不能继续走以人证为中心的刑事指控体系的老路,也不能走忽视人证作用的错路。审查人证应当秉持辩证思维,庭前阶段注重充分发掘人证中隐藏的客观性证据并降低构建起诉指控体系中对人证的依赖程度,庭审阶段则应增强构建庭审指控体系中对人证的运用能力,合理地发挥人证的应有功能。

The complete criminal accusation system consists of two parts： the prosecution accusation system and the trial accusation system. Historically,the human testimony has been the core content of the criminal accusation system. At this stage,it is still the key link in the construction of the criminal accusation system. At present,the reform of the substantive trial is significantly adjusting the role of the human testimony in the prosecution accusation and trial accusation. In this context,in order to actively adapt to the needs of the reform of the substantive trial,we can neither continue to follow the old path of the criminal accusation system centered on the human testimony,nor can we go the wrong way of neglecting the role of the human testimony. Review ing the human testimony should uphold the dialectical thinking. In the pre-trial stage,w e should focus on fully exploiting the objective evidence hidden in the human testimony and reducing the dependence on the human testimony in constructing the prosecution accusation system. In the trial stage,we should enhance the using ability of the human testimony in constructing the trial accusation system and reasonably play the proper function of the human testimony.
