土地征收行政公益诉讼的正当性根据及制度构建

Legitimacy basis and system construction of administrative public interest litigation in land acquisition

现行土地征收的司法性审查机制难以有效监督土地征收中的行政违法行为,更无法保障土地征收的公益性目的。行政公益诉讼作为客观诉讼,不同于以私益救济为根本目的的普通诉讼。保障公益征收的目的,监督政府的征地行为,强化检察监督与司法审查的原则,实现人权保障的价值为土地征收行政公益诉讼提供了正当性根据。构建我国土地征收行政公益诉讼制度的建议:赋予检察机关和特定社会组织公益诉讼起诉人的资格;确立土地征收行政公益诉讼可诉范围的识别依据;设立以检察机关的检察建议和社会组织的诉前通知为模式的诉讼前置程序。

The current judicial review mechanism for land acquisition is difficult to effectively supervise administrative violations in land acquisition,and it is even unable to guarantee the public interest purpose of land acquisition. Administrative public interest litigation,as an objective law suit,is different from ordinary law suits whose basic purpose is private benefit relief. It provides a legitimacy base for the administrative public interest litigation in land acquisition by safeguarding the purpose of public interest acquisition,supervising the government＇s behavior of land acquisition,strengthening the principles of procuratorial supervision and judicial review,and realizing the value of human rights protection. The proposal to construct the administrative public interest litigation system for land acquisition in China is to give the procuratorial organs and the specific social organizations the qualifications of the public interest litigants,establish the basis for the identification of the scope of the law suit for the administrative public interest litigation in land acquisition,and establish a mode of pre-litigation procedure based on the procuratorial recommendations of the procuratorial organs and the pre-suit notification of the social organizations.
