民法典编纂背景下的法教义学:定位与进路

Location and Approach: Dogmatics of Law in the Context of the Enactment of Chinese Civil Code

法教义学是以对实定法的确信为前提,以法解释、体系化和形式推理为内容的法学方法论,与民法典相辅相成,是法学科学性的重要保证。在民法典编纂的背景下,法教义学可与社科法学在分工合作的基础上和谐并存,成为未来中国民法研究的主要范式,并通过相互借鉴实现自身的革新。在这一定位下,法教义学发展需遵循正确处理继受与本土化之间的关系、确立中国司法裁判为目标的实践面向、从法解释发展为解释与续造并举等路径。

Dogmatics of law is a kind of methodology of jurisprudence. It’s based on the belief on positive law and its contents are legal interpretation, systematism, and formal reasoning. Actually, it is very necessary and useful to civil code, and it ensures the character of scientificity of the science of law. With the enactment of Chinese Civil Code, dogmatics of law should find its correct location. It should be the main research paradigm of legal research. It can be in harmony with social science of law that is important resources for innovation dogmatics of law through division and cooperation. As to the approach, dogmatics of law should deal with the relationship between law transplantation and indigenization correctly, take Chinese judicial adjudications as its practical aim and take rebuilding laws as seriously as interpretation.
