国际刑事司法准则视角下我国刑事辩护全覆盖问题研究

Study on the Full Coverage of Legal Aid of Criminal Defense from the Perspective of International Criminal Justice Guidelines

在刑事司法制度中全面推行审判阶段刑事律师辩护全覆盖对于保障被告人获得真实、全面和有效的辩护具有重要的意义。文章立足于国际刑事司法准则的基本要求,分析我国刑事辩护全覆盖的立法现状及其不足之处。在此基础上进一步提出如何在保障有效辩护的同时,实现刑事辩护覆盖的改革目标。

In the criminal justice system, it is of great significance to carry out the full coverage of the criminal lawyer undefined defense in the trial stage for ensuring the defendant to obtain the true,comprehensive and effective defense. Based on the basic requirements of the international criminal justice guidelines, the article analyzes the legislative status and shortcomings, and then points out the way how to guarantee the effective defense and implement the judicial reform aims of full coverage of legal aid of criminal defense in the criminal justice system.
