Contractor Legal Risk and Prevention of Construction Contract for Coal Construction Project

煤炭建设工程施工合同是煤炭工程施工、工程款支付及争议解决的基石;但在工程实践中,由于部分合同前期手续不规范、合同签订不严谨、合同履行不到位等原因,使得合同纠纷大量涌现。从承包人角度,分析了煤炭建设工程施工合同在前期准备、合同签订、履行阶段的主要法律风险,并提出了相应防范措施。

A construction contract of a coal construction project is a cornerstone to the construction of the coal project,the payment of the project fund and the dispute settlement.In the practices of the project,due to the irregular prior formalities of the partial contract,the imperfectly signed contract,the failure to perform the contract and other causes,many contract disputes would be occurred.From a view of the contractors,the paper had an analysis on the main legal risks occurred from the early preparation of the construction contract,the contract signed and the implementation stage of the coal construction project.The related prevention measures were provided.
