公私合营项目风险治理机制构建研究

摘要 公私合营(PPP)项目是一系列合约的合集,性质上属于企业联合,合作企业之间既有合作也有竞争。PPP项目中存在社会资本的机会主义风险与政府的信用风险。对社会资本机会主义风险可以结合监管与激励措施。针对政府可能出现的信用风险,要奉行风险公平分配原则,以法律法规代替政策,在个案中区分行政与民事法律关系。
