摘要 二十一世纪以来,世界经济飞速发展,但同时全球各国也面临着环境恶化以及不可再生资源过度消耗的问题。为使环境恶化现象得到有效遏制,必须对传统技术进行"绿色"创新,而专利制度与技术创新有着十分紧密的联系,文章将列举当今国外一些发达国家的绿色专利制度的发展情况,结合绿色发展理念,从完善绿色专利特殊审查机制并设立"绿色通道"以及创新专利强制许可制度入手,探讨如何设立一套适应于中国当前国情的绿色专利制度。 Since the beginning of the 21st century, the world economy has developed rapidly, but at the same time, the world has faced the problem of environmental degradation and excessive consumption of non-renewable resources. To effectively curb environmental degradation phenomenon, we must change the traditional technology with greening innovation. The patent system and technology innovation are very closely linked. This article listed green patent systems of some developed countries and combined with the concept of green development, it suggested improving the green patent review mechanism and setting up a special "green channel" and innovation patent compulsory license system. Meanwhile, this paper discussed how to set up a set of green patent system adapted to China's current national conditions.
