外国民商事判决承认与执行的可分性研究

在当前国际私法领域下,推动判决在全球的流通是众多学者关注讨论的话题。法院做出的判决被尽可能多的得到承认与执行,才能最大化的实现当事人意思自治的愿望,也能更好地维护当事人在外国的法律利益。为了更大程度的使判决得到承认与执行,判决承认与执行的可分割制度应运而生。该制度为当事人和法院对判决的承认与执行提供了自由裁量的空间。中国目前也面临着承认与执行外国民商事判决的难题,该制度的出现为中国解决困境提供了新的思考方向。

Under the current field of private international law, promoting the circulation of judgments in the world is a topie that many seholars pay elose attention to. The eourt made the verdiet reeognized and enforced as mueh as possible in order to maximize the desire to aehieve the party autonomy, but also to better protect the legal interests of the parties in foreign eountries. To make the judgment reeognized and enforced to a greater degree, a divisible system of recognition and enforcement of judgments came into being. The system provides the parties and the eourt with the diseretion to reeognize and enforee the judgment. At present, China is also faeing the problem of reeognizing and enforcing foreign eivil and eommercial judgments. The advent of this system has provided a new direetion for China to solve its predicament.
