纯粹经济损失概念中的可预见性规则研究

Study on the Predictability in Pure Economic Loss

为了确定纯粹经济损失这一动态概念体系中的考量因素,以英美侵权法为背景,采用比较法、判例法等方法,分析可预见性在纯粹经济损失界定过程中的意义,以及需要具体考虑的可预见性内容。结果表明,可预见性是纯粹经济损失概念确定时一个重要的考量因素,这种通过可预见性来界定纯粹经济损失的方法非常值得我国借鉴。

To determine the considerations in the dynamic concept of ＂ pure economic loss＂,using comparative method,case method etc,the thesis analyzes the meaning of the predictability in the define process of the concept pure economic loss,and the criteria for judge that need to take into account. The results show that the predictability is an important factor in the definition process of the pure economic loss. The method of defining the concept of Pure Economic Loss by analyzing the predictability is very worthy for our reference.
