通过解读离婚诉讼证据的特点以及离婚诉讼的证据种类,研究现实的离婚诉讼中所面临的具体问题,了解实务中的离婚诉讼的状况。从民事诉讼中证据认证、证明标准、法官自由裁量等角度结合到具体的离婚诉讼中的问题,从而更深入地研究离婚诉讼中存在的问题以及缺陷,并且通过认识离婚诉讼在认证过程中的问题、限制因素与完善来更好地认识离婚诉讼中证据运用的规则,最后提出对离婚诉讼证据完善的一些建议。

In modern society where the divorce rate has gradually increased,litigation divorce has also become a relatively common activity. Divorce proceedings involve issues such as property division,child support and debt assumption. Divorcement litigation,as a kind of civil litigation,has its unique characteristics,which leads to divorce lawsuits presenting different issues from other civil litigations. In response to these various problems and the various situations that arise in practice,through the interpretation of the characteristics of divorce proceedings evidence and the types of evidence in divorce proceedings,the specific problems faced in actual divorce proceedings are studied and the status of divorce proceedings. From the point of view of evidence verification,proof standards,and discretion of judges in civil lawsuits,the issues involved in divorce litigation are more in-depth,so that the problems and deficiencies in divorce litigation are studied in more depth,and problems in the certification process through divorce lawsuits are understood. With constraints and refinements to better understand the rules for the use of evidence in divorce proceedings,through the recognition and discovery of the above issues,and finally put forward some suggestions on divorce litigation evidence.
