第三方支付平台即时转账的风险和控制研究

A Study on the Risk and Control of Instant Transfer on the Third-party Payment Platform

互联网时代的到来使得第三方支付平台踏入历史舞台。支付宝(中国)网络技术有限公司是国内领先的第三方支付平台,致力于提供"简单、安全、快速"的支付解决方案。随着支付宝的快速发展,其在即时转账上出现了诸多风险漏洞,在一些关键环节,如用户即时转账的法律机制设计仍不健全,特别是当用户转错账,想从支付宝服务协议中获得解决途径时及要求享有对方返还的请求权的时候,却面临着重重困境;鉴于当下关于支付宝使用的风险控制和责任承担研究相当不足,本文依据相关法律规定和判例研究第三方支付机构涉及的法律关系和责任承担,通过实证案例分析支付宝即时转账规制及责任承担存在的问题和不足,系统梳理涉及的主要法律问题和责任分配,提出控制风险和改善的建议,以达到丰富我国第三方支付相关法律研究的目的,促进我国第三方支付的发展。

In the Internet era, the third party payment platform has made its debut. Alipay （China） Network Technology Co. Ltd, as a leading third party payment platform in the field, is committed to providing ＂simple, safe, and fast＂ payment solutions. With the rapid development of Alipay, risk loopholes appear in the key links of its instant transfer, such as the lack of an effective legal mechanism,which leads to difficulties in seeking solutions from the service agreement of Alipay or requesting a refund in the case of a false transfer etc. The current research on risk control and accountability for instant transfer is quite inadequate. Therefore, this paper studies the legal relationship and accountability involved in the third party payment agencies based on the relevant legal provisions and cases and analyzes the shortcomings of the risk control of Alipay in its instant transfer through empirical case analysis. Then it puts forward suggestions on the risk control to enrich the current legal research of the third party payment and also promote the implementation of the third party payment.
