环境民事公益诉讼程序定位及立法模式选择研究

环境民事公益诉讼程序定位是环境民事公益诉讼具体问题展开研究的逻辑起点。依托传统民事诉讼程序的环境民事公益诉讼,使其丧失了自己独特的个性。程序的设置应当与纠纷的类型相适应。环境民事公益诉讼立法目的和保护对象的特殊性,客观上决定了建立价值与规则同一的相对独立的环境民事公益诉讼特别程序更为合适。环境民事公益诉讼本质上属于民事诉讼的范畴,环境民事公益诉讼特别程序属于民事诉讼程序群的一员。环境民事公益诉讼特别程序立法有必要采用循序渐进的方式,近期可采用内置于现行民事诉讼法中的立法模式,在《民事诉讼法》中专章规定;当其具备较完善的立法体系内容,且立法时机成熟时,可单独制定特别程序法。
