我国大陆动物保护立法的完善——以我国台湾地区为借鉴

Perfection of Animal Protection Legislation in China's Mainland:A Case Study of Taiwan Region in China

关注动物保护,重视动物福利,越来越成为一种社会趋势,它不仅体现了一国的文明程度,更甚者会影响到一国的国际贸易发展。我国大陆的动物保护在立法上存在缺乏动物保护目的、保护范围狭窄模糊、保护程度低、公众参与制度不健全、法律规定零乱松散等问题。相比较而言,我国台湾地区的动物保护立法较为完善,值得我国大陆加以借鉴。在对我国台湾地区动物保护立法现状进行分析的基础上,提出从以动物保护为立法目的、立足国情划分动物保护范围、加强动物保护力度、整合社会力量促进立法实施、结合现状规划动物保护基本框架等方面,来完善我国大陆动物保护立法。

To pay attention to animal protection and to pay attention to animal welfare is becoming a social trend.It not only embodies the civilization of a country,but also affects the development of international trade in a country.The animal protection in the mainland of China has such problems as lack of animal protection,narrow scope of protection,low degree of protection,unsound public participation system,and loose legal provisions.Comparatively speaking,animal protection legislation in Taiwan region is relatively advanced,which is worth learning from China's Mainland.On the basis of the analysis of the present situation of animal protection legislation in Taiwan region of China,it is proposed to improve China＇s continental movement from the aspects of animal protection as the legislative purpose,the scope of animal protection,the strengthening of animal protection,the integration of social forces to promote the implementation of legislation and the framework of animal protection based on current situation planning.
