对人性的考量是法律创制的基础,中西方将人性论分为性善论、性恶论、以及无善无恶论。由人性阐发出来的道德有其局限性,有序社会的法律创制应该惩恶扬善,尽最大的责任维护善心善行。主流媒体也应该宣扬正确的价值观,营造行善的社会氛围。

The consideration of human nature is the foundation of legal creation. China and the West divide the theory of human nature into theory of original goodness of human nature,theory of original evil of human nature, and theory of no good and no evil. Morality explained by human nature has its limitations. The legal creation of an orderly society should punish evil and promote goodness, and do its utmost to uphold good heart and good deeds. Mainstream media should also promote correct values and create a social atmosphere for doing good things.
