The Criminal Nature of Deep Link Behavior

深层链接以界面呈现方式不同为标准,可分为加框链接和普通深层链接,加框链接是指在设链接者控制的网页或客户端界面上呈现作品的链接,而普通深层链接则仍是跳转至被链者控制的页面呈现作品。民事上的直接或间接侵权与刑事上的实行或帮助行为性质并非一一对应关系。《刑法》第217条保护的法益是整体的著作权,而不仅仅是相应行为对应的民事权利。从法益保护的目的出发,侵犯著作权罪禁止的传播行为是在设链者控制的页面或客户端界面上导致作品实质内容扩散的行为,因此加框链接属于传播之实行行为普通深层链接在一定条件下可构成传播之帮助行为。

By the standard of different interface presentation, deep link can be divided into frame link and or-dinary deep link. Framing links are links that are displayed on the webpage or client interface controlled by the linkers. The ordinary deep link is still skipping to the page controlled by the chain and presenting the work. Civil direct or indirect infringement is not one-to-one correspondence with the nature of criminal exe-cution or assistance. Article 217 of the Criminal Law protects the overall copyright, not just relevant civil rights corresponding to those behaviors. From the purpose of legal interest protection, the prohibition act of copyright crime is the act of spreading the essence of the linked work on the page or client interface controlled by the linking. Therefore,the framed link can be identified as the act of propagating, and the ordinary deep link in certain condition can constitute a help behavior of spreading.
