价值考量与立场选择:我国技术侦查的分歧与衡平路径实证研究

Value Considerations and Position Options: An Empirical Study on the Differences and Equilibrium Paths of Technical Investigation in China

寻求技术侦查运用的平衡点,是化解理论与实践分歧、实现打击犯罪与保障人权并重等诸多目的的重要环节。以审判为中心的诉讼体制改革对技术侦查司法化、证据使用、侦查人员出庭作证以及非法证据排除规则适用提出了新要求,制定了新规则。技术侦查法治化构建应立足技术侦查本身与现实国情,深入了解公、检、法各自立场,并对技术侦查相关问题进行实证研究。在司法改革的大背景下,应当权衡不同价值,保持理性立场,对技术侦查司法审查、技侦警察出庭作证以及"毒树之果"的排除都应当保持审慎的态度;对于证据质证、技术侦查监督和救济方面应当进一步加强和完善,并应加快推进技术侦查专门性立法工作。

Seeking the equilibrium of the use of technical investigation is to resolve the theoretical and practical conflicts,to fight against the criminals and to protect human rights,etc.. The trial-centered litigation system reform puts forward new requirements and new rules for the application of judicial investigation,the use of evidence, the testimony of investigators and the application of illegal evidence exclusion rules. The construction of technological investigation and rule of law should be based on the technical investigation itself and the actual situation,in-depth understanding of the public security law of their respective positions,and technical investigation related issues for empirical research. In the context of judicial reform,we should weigh the different values,maintain a rational position,and be prudent when considering the judicial investigation of technical investigation,police？ testifying,and the elimination of the ＂poisonous fruit＂. In terms of evidence,technical investigation supervision and relief should be further strengthened and improved,and the legislative works of the technical investigation should be accelerated.
