摘要
章程是个体学术自由转化为以团体人格化为特征的大学自治的象征,是形成大学团体意志、实现大学内部组织化的秩序规范。章程自主权构成大学团体自治的核心要素,决定着章程的功能定位。在不同的大学治理基本理念下,章程自主权存在差异。这种差异最终以章程的法律属性和效力位阶的形式体现出来。
The regulation is a symbol of university autonomy characterized by the transformation of individual academic freedom into a group personality. It is a norm of the formation of university group' s will and the organization of internal organization. The autonomy of the regulation constitutes the core element of university group autonomy and determines the functions of the regulation. Under the basic concepts of different university governance, there is a difference in the autonomy of regulation, and this difference is ultimately reflected in the form of the legal nature and effectiveness of the regulation.
