The Institutional Constraints for University Autonomy of Socialism with Chinese Characteristics

中国特色社会主义高校自治的制度约束不仅包括国家的宪法、法律、行政法规和部门规章,还包含以党章为核心的与高等教育有关的党内法规体系。在外部约束上,高校领导选任、人才管理、思想政治教育均受到党的领导;人事(含职称)、财务、卫生、消防、实验室、体育、国防教育和档案等方面,则接受政府的直接管理。在内部约束上,高校自治受到政治权力、行政权力、学术权力、民主权力与咨询权力的约束。两者共同构成的整体制度约束正是我国高校自治的实际情况。

The institutional constraints for university autonomy of socialism with Chinese characteristics contain not only the constitutions, laws, administration regulations and departmental rules, but also the inner Party regulation institutions related to higher education with the Party constitution as the core. In terms of the external constraint, the selection and appointment of university leaders, the management of talent, the education of ideology and polities are all under the lead of the Party, but personnel （ including professional titles）, finance, health, fire protection, laboratory, sports, national defense education ,archives and other aspects are subjected to direct administration by the government. In terms of the internal constraint, university autonomy is constrained by political power, administrative power, academic power, democratic power and advisory power. The overall institutional constraints jointly constituted by both the above are just exactly the actual present status of our country＇s university autonomy.
