摘要
2018年3月,全球首例自动驾驶汽车撞人致死事件引发了社会各界的激烈讨论。以此案件为切入点,本文对自动驾驶汽车可能涉及的法律责任、安全监管及认证等问题进行了讨论。本文认为,要求自动驾驶汽车以100%的安全可靠性作为其合法化的条件无疑是苛刻的,面对自动驾驶技术这一新事物,我们更加需要考虑的是,如何建立起配套的法律制度、伦理规范和其他相应设施,以确保自动驾驶汽车的安全性,为其发展助力。
In March 2018, the world' s first pedestrian death caused by a self-driving car triggered intense discussions from all walks of life. Taking this case as a breakthrough point, this article discusses the legal responsibility, safety supervision and certification about self-driving cars. And we believe that it is undoubtedly unreasonable to demand that the self-driving car to be 100% safe and reliable as a condition of legalization. In the face of this new technology, we need to consider more about how to establish a supporting legal system, ethical regulations and other facilities to ensure the safety of self-driving car and promote its development.
