知识产权制度的生态化研究

先进的知识产权制度应是注重人与自然和谐、注重生态文明建设的现代化制度,其对生态环境的影响利弊参半。为了进一步地加强知识产权制度的环保功能,应当将建设两型社会的理念融入其中。我国现行的知识产权制度对环境保护有一定的体现,但仍存在着不足之处。应从知识产权的各个制度入手,构建生态化的知识产权制度。

The advanced intellectual property system should be a modern system focusing on the harmony between man and nature and the construction of ecological civilization, and its impact on the ecological environment is double-edged. In order to further strengthen the environmental protection function of the intellectual property system, the concept of building a ＂resource-economical and environment-friendly society＂should be integrated into it. To a certain degree, environmental protection has been reflected in the current intellectual property system in China, but there are still shortcomings. Ecological intellectual property system should be constructed from the various systems of intellectual property.
