地方法治评估中权利指数的设计及应用

On the Design and Application of the Rights Index in the Local Rule of Law Evaluation

权利是衡量法治的核心价值,权利指数也应当是地方法治评估体系的重要组成部分。设计并实施地方法治评估中的权利指数的目标在于衡量各地区某一阶段的公民基本权利保护现状,发现其中的不足并加以解决,从而提高公民基本权利保障水平,推动我国法治建设发展。科学设计我国地方法治评估中的权利指数,要以我国法治建设总体目标为顶层设计,顺应我国法治发展规律,遵循自上而下的建构主义逻辑,并充分考虑到我国法治建设状况和地区差异,进而构建出适合中国国情的"本土化"指数。

Rights are the core value for evaluating rule of law, and the rights index should also be an important part of the local rule of law evaluation system. The goal of designing and using the rights index in the local rule of law evaluation is to measure the status quo of the protection of citizens＇ basic rights at a certain stage in all the regions, and find out the shortcomings and solve them, so as to improve the level of protection of citizens＇ basic rights and promote the development of rule of law in China. For scientifically designing the rights index in the local rule of law evaluation, China should adopt the overall goal of rule of law as the top-level design, conform to the laws governing the development of the rule of law in China, follow the top-down eonstruetivist logic, and fully take into account the status quo of the rule of law and regional differences in China, so as to create a ＂domestic＂ index suited to China＇s national conditions.
