外伤性膈肌破裂2例及其人体损伤程度鉴定分析

Analysis of Forensic Identification of 2 Cases with Traumatic Diaphragmatic Rupture and the Injury Degree in Human Body

外伤引起膈肌破裂、膈疝,在临床外科及法医鉴定中并不常见,对于外伤性膈肌破裂、膈疝,在我国司法鉴定人体轻、重伤评定标准中也没有专门的规定。现行的《人体损伤程度鉴定标准》只将膈肌破裂列入重伤二级,对于一些特殊情况导致的膈肌破裂未进行规定,只能比照《人体损伤程度鉴定标准》的相近条款进行鉴定,与实际损伤情况并不相符。通过对2例膈肌破裂的鉴定案件进行具体分析,对现行的膈肌破裂损伤程度法医学鉴定标准进行探讨。

Traumatic diaphragmatic rupture and diaphragmatic hernia are uncommon in both clinical surgery and forensic identification. And there are also no special provisions in our judicial identification to evaluate traumatic diaphragmatic rupture and diaphragmatic hernia. The current standards of the identification of body injury degree only point out that the diaphragmatic rupture is classified as serious injury Ⅱ, but as for the other special circumstances leading to rupture of the diaphragm no provisions are mentioned, so we can only follow the similar terms to assess, which sometimes might not be consistent with the actual damage. This article discusses the current standards of forensic identification of diaphragmatic rupture in human body injury through analysis of 2 cases with diaphragmatic rupture.
