对渤海环境保护特别法建设的新思考

New Thoughts on the Construction of Special Laws for Environmental Protection in Bohai

以往的海洋环境保护法没有让渤海恢复"美丽",不能满足新时代人民对"美好生活的需要"。以往的"促进经济社会发展"的一般立法目标无法接受专门的渤海环境保护法。承认独立的环境利益、以"美丽"为建设目标的绿色发展理念支持按照环境保护需要为保护渤海环境制定专门法。我们已经具备以实现环境质量改善为目的为渤海制定专门法的条件:以环境质量为直接规制目标的环境立法设计理论已经创立,立法和政策制定已经采用了环境质量目标主义设计思路,一些环境保护实践已经运用了环境质量目标指挥棒。把全面深化改革对国家治理能力现代化的要求落实在渤海环境治理上,制定专门法应当成为渤海环境保护当然的立法模式选择。

The past marine environmental protection law did not restore the beauty of Bohai Sea,and could not meet the needs of people in the new era for better life. In the past,the general legislative goal of promoting economic and social development could not accept the special environmental protection law of Bohai Sea. But the Green development concept recognizes the independence of the environmental interests and take beautyas its goal. In this case,it supports us to establish a special law to protect the environment of Bohai. We already have the conditions to establish a special law which on the purpose of achieving the goal of environmentquality improvement in Bohai： The environmental legislation design theory,which is directed by the environmental quality as the direct regulation goal,has been established; The legislation and policy formulation have adopted the idea of environmental quality objective design,and some environmental protection practices have already used the environmental quality order as their baton.According to the reasons above,the implementation of the requirements for the modernization of the national governance capacity in the comprehensive deepening of the reform in Bohai environmental governance and the formulation of special law should be the choice of the legislative mode of environmental protection in Bohai.
