互联网和新媒体环境下我国体育赛事转播权侵权的原因探析

An Analysis of the Causes of the Infringement of the Broadcast Right of Sports Events in China under the Environment of Internet and New Media

本文将通过文献资料法、定性法和逻辑分析等研究方法对我国体育赛事转播权的现状及侵权原因进行探讨。研究发现:造成我国体育赛事转播权侵权的原因在于:1.法律性质归属不清;2.追责成本低、维权困难;3.盗播媒体追求利益;4.用户尚未养成付费观看习惯且缺乏转播权保护意识。基于此,本文提出以下建议:1.明确体育赛事转播权的法律权利归属,增加问责性;2.加强技术维护,提升体育赛事转播权保护意识。

This paper discusses the present situation and the cause of infringement of the broadcasting fight of sports events in China through the methods of literature, qualitative analysis and logic analysis. The Lstudy found that the reason for infringement of broadcasting rights of sports events in China lies in ： 1. The nature of the law is unclear; 2. The cost of pursuing responsibility is low, and safeguarding rights is difficult; 3. Theft of media pursuit of interests ; 4. Users have not yet formed the habit of paying to watch and lack of awareness of broadcasting rights protection. Based on this, this paper puts forward the following suggestions： 1. Make clear the legal fight owner- ship of sports event broadcast right, increase accountability. Strengthen the technical maintenance ; 2, . Enhance the sports event broadcast fight protection consciousness.
