秦“执法”服“法冠”说考论

东汉蔡邕《独断》在追溯"法冠"起源时,说"秦制,执法服之",其中的"执法"实际是指掌握执法职能的职官群体,为东汉时的概念,而非秦简中出现的职官——执法。胡广"秦灭楚,以其君冠赐御史"一说则是他对秦灭六国、"兼其车服"进行理论建构的一部分,不能作为可以信据的秦代史料。但胡广此说将秦御史服法冠的记载固定化,且为汉唐官制文献所沿袭和增改,从而形成了深刻的历史记忆。东汉时期除御史作为执法职官继续服法冠外,廷尉属官也具有了佩戴法冠的资格,这反映的是汉代执法涵义的变化。
