国际组织责任语境下用尽当地救济规则的适用性问题分析

Analysis of the Applicability of the Rule of Exhaustion of Local Remedies in International Organization Responsibility

《国际组织的责任条款草案》规定了援引国际组织责任应适用用尽当地救济规则,但国际法学界对此问题存有争议。国际组织责任制度可以借鉴国家责任制度,用尽当地救济规则对国际组织责任具有适用性。但国际组织毕竟不同于国家,在责任规则上有一定的差异性,用尽当地救济规则须进行调适后才可以更好地适用。

The Draft articles on the responsibility of the international organization have provided that the rule of exhaustion of local remedies should be applied when invoking the international organization＇s responsibility. But some international scholars still argued about this problem.State responsibility system has been used for reference to International organization responsibility system and the rule of exhaustion of local remedies shall apply to International organizations. Because International organizations are not states after all and there are certain differences in liability rules,the rule of exhaustion of local remedies should be adjusted to better apply.
