我国涉外劳动合同法律适用规则探析

摘要 我国《涉外民事关系法律适用法》第四十三条就涉外劳动合同的法律适用作出专门规定,其采用最密切联系原则,体现弱者利益保护的立场,具有明显的进步性。但该条规则绝对地排除当事人意思自治,就例外情形的规定不够全面,且某些措辞稍显随意。我国可纳入有限的意思自治,增加例外规定,并纳入结果定向方法,对第四十三条规定进行一定的完善。 The article 43 of Applicable Law of Foreign-related Civil Relations provides special provisions about employment contracts.The article 43 makes use of the most significant relationship principle,and embodies the protection of the weak position.But this article rules out party autonomy completely,and the exception rule is limited,in addition,some words lack of certainty.It is suggested that to employ conditional party autonomy,add to exception rules,and provide resultselective rule to perfect the article 43.
