Misapplication of FIDIC Conditions in International Projects and Corresponding Countermeasures

在国际工程中,FIDIC合同条件在全球多数地区被广泛应用和推广,对业主方及承包方责任义务做了明确分配,因此需要加强FIDIC合同条件在国际工程中的应用研究。文章通过阐述FIDIC合同条件的产生及应用发展历程,分析国际工程中广泛采用的合同模板——FIDIC合同条件常见应用误区,并提出相应的对策,为合同编制者、管理者和执行者提供借鉴。

In contract performance of the international projects,FIDIC contract conditions are widely developed and applied in the world-wide. These conditions clearly specify liabilities and obligations of the Employer and the Contractor respectively. The application study of FIDIC conditions in the international projects shall be enhanced accordingly. In this paper,courses of FIDIC conditions formation and ap-plication are described. The common misapplication of FIDIC conditions being widely applied in the international projects are analyzed and their corresponding countermeasures are proposed as well. This provides contract organizers,managers and performers with reference.
