电子商务快递包装绿色化的法律规制研究

Research on Laws and Regulations on Green Express Package in E-commerce Environment

分析了电子商务快递包装带来的资源消耗和环境污染的主要问题及其原因,在借鉴西方发达国家和地区包装绿色化法治经验的基础上,基于生产者延伸责任制度理论和绿色包装的"4R1D"原则,提出完善电子商务快递包装绿色化的法治建议,主要包括建立系统的、覆盖包装产业链全过程的法律体系,包括事先预防、事中管制监控、事后补救等;明确界定了电商快递包装绿色化的三个层面、五个行为主体及其法律责任和义务;建立快递业包装物回收体系;加强激励类绿色包装法律制度的建设等。

This paper analyzes the main problems caused by the e-commerce express packages, such as high resource consumption and serious environmental pollution. Then, based on the experience of the western developed countries and regions in green packaging legislation and using the extended producer responsibility system theory and the 4R1D principle in green packaging, it puts forward the suggestions to improve the legislation concerning e-commerce green express packages, including establishing a systematic legal system to cover the whole process of the packaging industrial chain, from ex ante prevention, to in-process monitoring and control, and to ex post remedy; clearly defining the three levels and five actors in the legislation of e-commerce green express packages, as well as their legal responsibilities and obligations; establishing a package recycling system for the express delivery industry; and strengthening the construction of incentive policies, etc.
