摘要
农地信托作为呼应农业供给侧结构改革、落实"三权分置"的重要实践,对盘活农村闲置土地资源,创新农地流转融资而言具有巨大促进效应;但我国目前相关制度建设尽付阙如,法律壁垒仍然存在。结合益阳、桃园、宿州实践经验,农地信托建设一方面应有效厘定政府权能边界,在政府严把信托公司准入及监督关口的同时充分发挥市场效能;另一方面,相关部门应夯实农地信托法律制度根基,尽快明确受托人主体范畴,合理配置责任义务并给予制度激励保障。
As an important practice of responding to the reform of the agricultm'al supply-side structure and the implementation of the "three rights division", the Farmland Trust has a great effect on the reactivation of the rural idle land resources and the innovation of the agricultural land transfer financing; however, the construction of the relevant system in China is still lacking, and the legal barriers still exist. In combination with the practical experience of Yiyang, Taoyuan and Suzhou, the construction of land trust should be effective to determine the government's power and energy boundary, and to give full play to the market efficiency while the government strictly controls the admittance and supervision of the trust companies ; on the other hand, the relevant departments should consolidate the root of the legal system of farmland trust and make clear the subject category of the trustees as soon as possible. Reasonable allocation of responsibility and obligation and incentive system.
