网约车驾驶员劳动权益保护探析

Analysis on the Protection of Labor Rights of Online-booking Taxi Drivers

身份的合法化使网约车的优势得到了更大程度的显现,但也给传统劳动力用工市场带来了新问题。其中最突出的问题就是怎样适当保护网约车营运服务中网约车驾驶员的劳动权益。本文通过对网约车驾驶员劳动权益保护存在问题的揭示,提出构建灵活安全的网约车劳动力市场、优化社会保障制度、完善劳动关系认定的标准、落实网约车企业的社会责任,以求在合理的限度内积极维护网约车驾驶员的劳动权益。

The legalization of online-booking taxis has increasingly shown their advantages,but on the other hand,it has brought some new problems to the traditional labor market.One of the most prominent problems is that how to protect the drivers＇ labor rights in the online-booking taxi service reasonably.By revealing the problems existing in the labor rights protection of the drivers,the paper comes up with some suggestions such as,constructing a flexible and safe online-booking taxi market and promoting the social insurance system,improving the standard to identify the labor relation and put the social responsibilities of online-booking taxi companies into practice,so that the labor rights of the online-booking taxi drivers can be protected moderately and positively.
