网络技术时代下私人复制的探究

互联网技术的快速发展使著作权人和出版者的权益遭受到前所未有的冲击,继而私人复制问题又一次成为了焦点。网络技术的开放性和灵活性造成了私人复制的泛滥。对私人复制概念进行界定,明确私人复制的界限,分析互联网的技术使私人复制的方式方法改变对著作权制度的冲击所带来的问题,从法律的角度提出规范私人复制行为从而保护著作权人和出版者的相关权益。

The rapid development of internet technology has caused an unprecedented impact on the rights andinterests of the copyright owners and publishers, and the issue of private reproduction has become the focus again.The openness and flexibility of network technology has led to the proliferation of private replication.This paper firstlydefines the concept of private copying, and clears boundaries of private copying; secondly analyzes the problemsbrought about by the internettechnology to change the impact of the copyright system on the way of privatereproduction; finally, proposes private copying behavior from the perspective of law to protect the rights and interestsof the copyright owners and publishers.
