美国环境上诉委员会制度将行政上诉制度与环境领域行政工作的特征进行了融合,对制度规则进行了专门化的设计并作为实践指引;以对环境上诉法官的法律实施经验要求保证其专业素质,以广泛的上诉人范围保障个人环境利益和环境公益,以"替代性纠纷处理"程序灵活解决环境行政争议。我国环境行政复议制度可以在提高复议人员专业素质、扩大申请人范围、完善调解制度等方面进行借鉴。

The system of Environmental Appeals Board guaranteed the professional quality of the environmental appeals judge by the requirements of the experience of enforcing the law, the personal and common environmental interests with the large range of the appellants, the flexible solution of environmental administrative disputes with ADR.The system of environmental administrative reconsideration in China will draw lessons from it in the way of improving the professional quality of the personnel, expanding the scope of the applicant and perfecting the mediation system.
