宗教活动场所法人化建设刍议

The Attempting Discussion of Legal Construction in Sites of Religious Activities

随着宗教活动场所日益广泛参与民事活动,赋予宗教活动场所法人资格,对于保障和促进宗教信仰自由意义重大。2017年3月15日颁布的《中华人民共和国民法总则》九十二条首次承认赋予宗教活动场所捐助法人资格。文章通过对宗教活动场所相关法律法规剖析,深入探讨宗教活动场所的法律定位,进而提出宗教法人制建设的进路。

As sites of religious activities is increasingly involved in civil activities, it is important to vest the legal person qualification to sites of religious activities, significant for guaranteeing and promoting freedom of religious faith. In the article 92 of ＂General provisions of the civil law of the People＇s Republic of China＂, which was issued on 15, March,2017, it firstly admitted that sites of religious activities were vested donation legal qualification. Through analyzing the relevant laws of sites of religious activities, this paper deeply explores the legal orientation of sites of religious activities, so as to provide the access to the construction of religious legal person system.
