论新能源汽车技术创新的保护与共享——基于绿色专利联盟的进路

The Discussion about Innovation Protection and Sharing on the New Energy Vehicle Technology——basing on the Green Patent Alliance Approach

新能源汽车技术作为一种低碳技术,不仅受到知识产权法的保护,也受到国际低碳潮流及其立法的影响。对新能源汽车技术的保护既要实现对技术创新带来的私益保护,又要实现低碳节能的环境公益目的。为实现新能源汽车技术的创新保护与合作共享,需要从国际法律谈判、国内专利法修改、国内政策三个层面推动企业建立绿色专利联盟,以实现技术创新保护与合作共享的平衡。

As a low-carbon technology,new energy vehicle technology is not only protected by intellectual property law,but also influenced by international low carbon tide and its legislation. The protection of new energy vehicle technology should not only achieve the private benefit protection of technological innovation,but also realize the environmental public welfare purpose of low carbon and energy saving. In order to realize the innovation protection and cooperation sharing of new energy vehicle technology,it is necessary to promote the establishment of green patent alliance from the three levels of international legal negotiation,domestic patent law modification and domestic policy,so as to achieve the balance of technology innovation protection and sharing.
