地方人大审查监督“两院”司法解释性文件的运行困境与突破路径

《中华人民共和国各级人民代表大会常务委员会监督法》将政府规范性文件纳入审查监督的范围,但其并未规定对"地方两院"制定的司法解释性文件的审查监督,同时"两高"虽发文明令禁止"地方两院"发布司法解释性文件,但"两院"司法解释性文件在司法审判现实需求下依旧呈现"禁而未止",此即催生围绕"地方人大应否实施对‘两院’司法解释性文件审查监督"的系列论争。以此为切入点,深入剖析地方人大审查监督"两院"司法解释性文件所遭受的阻隔困境,并在对地方人大审查监督"两院"司法解释性文件予以"必要性"证成之基础上,探寻实现地方人大对"两院"司法解释性文件审查监督的"崭新路径"。

Supervision Law of Standing Committees of People＇s Congresses at all Levels of the People＇s Re- public of China has incorporated the government＇s normative documents into the scope of the examination and supervision, but it does not stipulate the examination and supervision of the judicial interpretative documents formulated by the ＂local two courts＂. At the same time, although the ＂two supreme organs＂ issued an order to prohibit the release of judicial interpretative documents by the ＂local two courts＂, the judicial interpretative documents of the ＂two courts＂ were still ＂prohibited but not valid＂ under the actual demand of judicial trial, which brings about a series of debates about whether the Local People＇s Congress should carry out the judicial interpretation and supervision of the judicial interpretative documents of the ＂two courts＂.Taking this as the breakthrough point, the author makes an in-depth analysis of the difficulties encountered by the Local Peo- ple＇s Congresses in examining and supervising the judicial interpretative documents of the two courts. On the basis of the examination and supervision of the ＂necessity＇of the judicial interpretative documents of the ＂two courts＂ by the Local People＇s Congress, the ＂new path＂ for the Local People＇s Congress to inspect and super- vise the judicial interpretative documents of the ＂two courts＂ is explored.
