当代中国法理学的思维方式与研究路径

Thinking Mode and Research Approach for Contemporary Chinese Jurisprudence

法理学作为一个学科,它的本质规定性不在研究对象,而在思维方式。反思的思维方式构成了法理学的本质规定性。以"反思"为基础,法理学有着自己独特的研究路径与方法,构成了当下中国法理学研究的自身规律和内在逻辑。当代中国的法理学要关心的是中国的现实问题,强调在中国传统和文化中分析问题,强调解决中国社会遭遇到的、中国人最关心的问题,因此它是建立在"中国"意义上的中国法理学。

As a discipline, the essence of jurisprudence lies in its thinking mode rather than its research object： to be exact, the reflective way of thinking constitutes the essence of jurisprudence. Based on its dependence on reflection, jurisprudence has its unique research approach and methodology, which form the rule and inner logic governing the research on philosophy of law in contemporary China. This requires us to focus on China＇s realities, analyze them in Chinese tradition and culture, solve the problems which face the Chinese society and attract the greatest concern among Chinese people when developing contemporary Chinese jurisprudence. Only when this is done can we have a Chinese philosophy of law in the real sense of the word ＂Chinese＂.
